This equipment controls heavy mechanical and electrical systems. Improper installation, configuration, maintenance, or operation may result in serious injury, death, catastrophic equipment failure, property damage, or environmental harm.

Read this document in full before installing or using this equipment. Use of this equipment constitutes acceptance of these Terms.

Boat lift operation involves inherent and significant risks, including but not limited to:

• Mechanical failure
• Catastrophic system failure
• Structural collapse
• Electrical hazards
• Crushing injuries
• Drowning
• Vessel, dock, and property damage
• Environmental damage or contamination

The end user knowingly and voluntarily assumes all such risks, including the risk of total system failure, catastrophic loss, injury, or death, whether foreseeable or unforeseeable.

By purchasing, installing, or using this equipment, the end user acknowledges and agrees they are solely responsible for:

• Hiring qualified, licensed electricians and installers for all electrical and installation work
• Compliance with all applicable local, state, and federal laws, codes, and regulations
• Proper installation, grounding, surge protection, and electrical safety
• Regular inspection, testing, maintenance, and safety checks
• Proper training of all operators
• Maintaining continuous line-of-sight during lift operation
• Never leaving a moving lift unattended
• Ensuring safe operating conditions at all times
• Any and all damages, injuries, or losses resulting from use
• Understanding and accepting all risks associated with boat lift operation

You are responsible for your use of the Atlantis Control Systems websites, applications, and services (collectively, the “Sites”) and for any information or content you submit or transmit through them.

By accessing or using the Sites, you agree that you will not, directly or indirectly:

• Copy, reverse engineer, decompile, disassemble, attempt to derive source code, create derivative works from, distribute, sell, sublicense, or otherwise exploit any portion of the Sites, software, firmware, or related content, except as expressly permitted by law
• Access the Sites through unauthorized or non-approved interfaces or methods
• Post or transmit unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content
• Impersonate any person or entity or misrepresent affiliation
• Upload malware, viruses, corrupted data, or otherwise disrupt systems or security
• Remove or alter proprietary notices, copyrights, trademarks, or legal labels
• Violate any applicable laws or intellectual property rights
• Scrape, frame, mirror, automate, or manipulate the Sites without authorization
• Use the Sites for any unlawful or prohibited purpose

Atlantis Control Systems reserves the right to suspend or terminate access for violations of this section.

If you use the Atlantis Marina management platform (the “Platform”), the following additional terms apply:

The Platform is provided as a management and operational tool for marinas and marine facilities.

Atlantis Control Systems is not a party to any rental agreement, reservation, slip assignment, or transaction between a Marina and a boater.

Atlantis Control Systems does not guarantee:

• Slip availability
• Utility availability (power, water, connectivity)
• Dock or facility condition
• Safety or suitability of any marina or slip
• Conduct, actions, or omissions of any user

Payment services are provided by third-party payment processors (such as Stripe).

Atlantis Control Systems is not a bank, does not hold funds, and does not control transaction settlement, chargebacks, or disputes related to payment processing.

All payment transactions are subject to the applicable processor’s terms and policies.

Marinas retain ownership of their business and operational data entered into the Platform.

By using the Platform, you grant Atlantis Control Systems a limited, non-exclusive license to access, use, copy, store, and process such data solely to provide the Services, including analytics performed in an aggregated and anonymized manner.

Any disputes related to:

• Reservations
• Cancellations
• Refunds
• Property damage
• Vessel damage
• Service quality

are solely between the Marina and the boater.

Atlantis Control Systems has no responsibility or liability for such disputes.

Atlantis Control Systems warrants that each physical device will be free from manufacturing defects and premature component failures in materials and workmanship for two (2) years, when installed and used in accordance with published instructions (“Limited Device Warranty”).

Premature component failure means failure under normal use within rated specifications, excluding external causes.

The warranty period begins on the date of installation by Atlantis Control Systems or an authorized dealer. If unverifiable, it begins on the date of original sale.

The warranty is transferable from dealer to end user and one additional subsequent owner within the original two-year period. The warranty does not reset or extend upon transfer.

Atlantis Control Systems may offer an optional Extended Warranty extending coverage for an additional two (2) years for a fee of USD $200 per device.

Except for the Limited Device Warranty expressly stated above, all products and services are provided “AS IS” and “AS AVAILABLE.”

Atlantis Control Systems disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing or trade practice.

No oral or written statements create additional warranties.

All software, firmware, configuration files, and updates are provided “AS IS.”

Atlantis Control Systems makes no warranties regarding accuracy, reliability, availability, or performance. No guarantee is made of uninterrupted or error-free operation.

Software and firmware are not safety-critical systems and do not replace physical safeguards or safe operating procedures.

Atlantis Control Systems shall not be liable for issues arising from software bugs, misconfiguration, network outages, dependency changes, or updates.

Remote monitoring and control features rely on third-party networks, internet connectivity, cellular service, and cloud platforms beyond the control of Atlantis Control Systems.

Atlantis Control Systems does not guarantee availability, latency, or reliability of remote access features. Delays, interruptions, or loss of connectivity may occur.

Remote features are provided for convenience only and must not be relied upon as the sole means of control or monitoring. Local, line-of-sight supervision and physical controls remain the primary and required method of safe operation.

Certain features of the Atlantis Control Systems mobile applications, cloud services, or connected services may require a paid subscription, offered on a monthly or annual basis.

Pricing, billing terms, renewal options, and available features are disclosed at the time of purchase through the applicable app store or authorized sales channel and may vary by product, region, or service tier.

Atlantis Control Systems reserves the right to modify, introduce, or discontinue subscription-based features at any time.

All subscription purchases, renewals, cancellations, and refunds are handled exclusively by the applicable app store or payment provider and are subject to their terms and policies.

Use of non-Atlantis Control Systems components, accessories, wiring, software, or modifications not expressly approved by Atlantis Control Systems may impair operation, increase safety risk, and void warranty coverage.

Atlantis Control Systems assumes no responsibility for failures, damages, or injuries resulting from unauthorized modifications or third-party accessories.

To the maximum extent permitted by law, Atlantis Control Systems shall not be liable for indirect, incidental, consequential, special, or punitive damages, including personal injury, death, property damage, loss of profits, data, or business interruption.

Total liability shall not exceed the amount paid for the product giving rise to the claim.

The end user agrees to indemnify, defend, and hold harmless Atlantis Control Systems and its officers, directors, employees, agents, affiliates, and principals from claims arising from installation, operation, misuse, or violation of these Terms or applicable laws.

All risk associated with the purchase, installation, and use of this equipment is assumed solely by the end user.

These Terms are governed by the laws of the State of Florida. Any legal action shall be brought exclusively in Florida state or federal courts.
